Rental Agreement

The parties hereto, in consideration of these presents, agree as follows:

1. Renter agrees to be responsible for full payment of the rental amount and other fees, a fifty percent deposit and reservation fee being due upon confirmation of the rental. Reservations are confirmed upon processing of Renter’s credit card. Changes in confirmed reservations are subject to the cancellation policy. The final balance and security deposit are due in our office by May 1. When payment is made by credit card at least one of the individuals signing the rental agreement must be the person whose name is on the credit card. Failure to make payments when due will result in termination of this agreement and forfeiture of the initial deposit and fees.

2. In the event of cancellation, for any reason, all rental monies will be refunded minus a service fee of twenty-five per cent of the total rental rate if the premises are re-rented for the entire time reserved. All notices of cancellation must be in writing and mailed to our office. Reservation fees are non-refundable. There are no refunds for reservations with payments outstanding.

3. Renter agrees not to exceed the occupancy limits of the property and that these occupancy limits include ALL children and any overnight guests. Renter agrees that non-compliance with the occupancy limit is grounds for immediate termination of this agreement without refund of rental monies and that Renter and Renter's party will be required to leave the premises. Renter agrees that occupancy is limited to the individuals listed on this agreement.

4. In the event of damage to the premises, its equipment, furniture or carpeting, Renter agrees to be responsible for all damage costs exceeding the amount of the security deposit waiver insurance, including collection costs and attorneys fees. Documentation detailing charges will be provided to the Renter. All rental properties are subject to inspection prior to the arrival of the next occupant.

5. The property owner or the owner's agent may enter the premises at any time in the event of emergency or if there are indications that the occupancy limit has been exceeded or pets are present. Absolutely no pets of any description will be kept in the rental property or surrounding areas. Agent will use its best efforts to give 24-hour notice for normal maintenance or sales inspections.

6. Renter agrees to maintain the cleanliness of the premises during the occupancy and to leave the premises thoroughly clean and in good condition upon departure.

7. Check-in time is between 3:00 PM and 5:00 PM on the day of arrival. Renter must sign for keys in person at check-in. Keys cannot be left for renters who do not arrive by close of business.

8. Check-out time is 10:00 AM on the day of departure. Renter and Renter's entire party must vacate the property and return all keys to office not later than 10:00 AM.

9. The homes and condominiums offered for rent are privately owned and reflect the tastes of each owner Renter must furnish their own towels, cleaning supplies, paper products and bed linens (unless otherwise indicated on the data sheet.) Renter agrees to accept the property upon arrival provided it meets the basic specifications as described in the data sheet on the web site and agrees that he/she will not be entitled to a refund and will have no claim or recourse against Agent. Renter agrees that he has read the reservation information and agrees with the terms. In the event that the property rented is removed from our rental program for any reason the guest shall not hold Agent liable. Agent will relocate guest to a comparable accommodation. If such accommodations are not available, the guest will receive a full refund.

10. The property owners make every effort to keep their property and its equipment in good working order. Service requests for repair of air conditioning, televisions, appliances, etc. will be responded to as quickly as possible. There are no rebates or refunds issued to Renter for inoperable appliances.

11. If the Renter defaults and/or otherwise fails to comply with any item in this agreement, the agreement may be immediately terminated without refund.

12. Neither property owner nor Agent shall be liable for events beyond their control which may interfere with occupancy including but not limited to Acts of God, fire, strikes, war, inclement weather and nearby construction.

The renter agrees that Great Locations Real Estate, Inc shall not be liable to Renter, Renter's guests, invitees or any other person for any injury, loss, or damage to any person or property on or about the rental premises. Renter shall hold Great Locations Real Estate, Inc. harmless and indemnified from and against all loss or damage occasioned by use, misuse or abuse of any part of or fixture on the premises, surrounding areas and from or against any omission, neglect, or default of the Renter, his guests or invitees. The Renter acknowledges that Great Locations Real Estate, Inc, acting solely in the capacity of Agent for the property owner, assumes no liability thereunder.

This agreement may not be modified.

This agreement may not be assigned or the property sublet.

This agreement shall be deemed to be a contract made under the law of the Commonwealth of Massachusetts and for all purposes shall be governed and construed in accordance with the laws of said Commonwealth.
